These terms cover your use of SmartPES (the “app”), an iPhone app made by 67 Enterprise LLC (“we”, “us”), and the servers behind it that process and store your designs (the “service”). They supplement Apple’s Licensed Application End User License Agreement.

What the app does

You pick your embroidery machine’s hoop size, then either describe an idea (the app generates artwork) or upload your own artwork. The app turns it into a machine-embroidery stitch file checked for sewability, in PES, DST, EXP, JEF, VP3 and XXX formats.

Your artwork

You keep the rights to artwork you upload, and you must have the right to use it. Designs may not include logos, trademarks, copyrighted characters or likenesses of real people without permission. We may refuse or remove designs that break this rule.

AI-generated artwork

Artwork the app generates from your idea is provided as is. It may resemble existing works. You are responsible for how you use designs, including commercially.

Designs and purchases

“Designs” are consumable in-app purchases through Apple. Each finished design uses one. A design that fails, or that our automatic check says won’t sew cleanly, doesn’t use one.

Designs have no cash value, aren’t transferable, and are lost if you delete your data. New installs get 2 free designs.

Refunds go through Apple. Use reportaproblem.apple.com.

Sewing results

We check stitch files automatically for size, colors, jumps and density. How a design sews still depends on your machine, fabric, stabilizer and thread, so test-sew first. We don’t guarantee that a design will sew perfectly on every machine.

Service availability

The service may change or be interrupted.

Disclaimer and limitation of liability

The app and the service are provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows.

To the fullest extent the law allows, 67 Enterprise LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or time. Our total liability to you for all claims relating to the app and the service is limited to what you paid for designs in the app.

Nothing here limits liability that can’t be limited by law.
